LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Competition) (South Wight Borough Council) (Sports and Leisure) Regulations 1992

Laid before Parliament 10th January 1992
Coming into force 31st January 1992

    The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 6(3) and 15(6) and (7) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Local Government Act 1988 (Competition) (South Wight Borough Council) (Sports and Leisure) Regulations 1992 and shall come into force on 31st January 1992.

        (2)  In these Regulations—
      "the Act" means the Local Government Act 1988;

      "the Council" means South Wight Borough Council;

      "the principal Regulations" means the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1990[2]; and

      "specified work" has the same meaning as in the principal Regulations.

    Application of section 6 of the Act
        2.—(1)  Regulation 2 of the principal Regulations shall not apply in relation to specified work proposed to be carried out by the Council.

        (2)  Section 6 of the Act shall apply to any specified work which is proposed to be carried out by the Council on or after 1st January 1993.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations postpone, in the case of South Wight Borough Council, the requirement in the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1990 that the management of sports and leisure facilities be put out to competitive tendering. This requirement, which would otherwise take effect on 31st January 1992, is postponed to 1st January 1993.
