POLICE

The Police (Amendment) (No. 3) Regulations 1991

Coming into force 1st February 1992

    In exercise of the powers conferred upon me by section 33 of the Police Act 1964[1], and after taking into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and furnishing the said Board with a draft of the Regulations in accordance with section 2(1) of the Police Negotiating Board Act 1980[2], I hereby make the following Regulations:
        1.    These Regulations may be cited as the Police (Amendment) (No. 3) Regulations 1991.
        2.    These Regulations shall come into force on 1st February 1992 and shall have effect for the purposes of regulation 3(3), (4) and (5) as from 20th March 1991; but regulation 53 shall continue to apply as it had effect immediately before the coming into force of these Regulations in relation to any move which took place before 20th March 1991.
        3.    -

        (1)  The Police Regulations 1987[3] shall be amended in accordance with the following provisions of this regulation.

        (2)  There shall be inserted at the end of regulation 46 (pay day) the following paragraph:
      "  (3)  The police authority may, if they think fit, pay to a member such part of his pay as they may determine in advance of the day on which it would otherwise be due to be paid in accordance with this regulation." .


        (3)  In paragraph (1)(d) of regulation 53 (removal allowance) for the word "13" there shall be substituted the word "26" and for the words "a further period not exceeding 39 weeks" there shall be substituted the words "such further period as they may determine".

        (4)  In regulation 53(7) for the words "£600" there shall be substituted the words "£1,200".

        (5)  In regulation 53(10)(b) there shall be inserted-
       (a) after the word "fees" the words ",stamp duty", and
       (b) at the end the words ";and any reference to expenses incurred in connection with the acquisition of any property shall be construed as also including expenses in connection with the contemplated acquisition of a property other than that acquired.".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations further amend the Police Regulations 1987. Regulation 3(2) ensures that police authorities may make advances of pay to members of police forces. The provision in respect of removal allowance is amended by regulation 3(3), (4) and (5) , so as to increase eligibility for the reimbursement of mortgage interest or rent, increase the maximum amount payable in respect of incidental expenditure and clarify the meaning of certain reimbursable expenses. Paragraphs (3), (4) and (5) of regulation 3 have effect from 20th March 1991 (retrospection is authorised by section 33(4) of the Police Act 1964), if the move took place on or after that date.
