SALMON AND FRESHWATER FISHERIES

The Rivers Tweed and Eye Protection (Renewal) Order 1991

Made 7th October 1991
Coming into force 8th October 1991

    The Secretary of State, having received no complaints concerning the implementation of proposals, and in exercise of the powers conferred upon him by section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 1976[1] and of all other powers enabling him in that behalf, hereby makes the following renewal Order:
    Citation and commencement
        1.    This Order may be cited as the Rivers Tweed and Eye Protection (Renewal) Order 1991 and shall come into force on 8th October 1991.
    Interpretation
        2.    In this Order—
      "the 1980 Order" means the Rivers Tweed and Eye Protection Order 1980[2];

      "the 1988 Order" means the Rivers Tweed and Eye Protection (Renewal) Order 1988[3].

    Renewal of Order
        3.    The 1988 Order is hereby renewed.
    Prohibition
        4.    During the period from 8th October 1991 to 7th October 1994, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1980 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order renews for the fourth time the prohibition contained in article 3 of the Rivers Tweed and Eye Protection Order 1980 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition has effect from 8th October 1991 to 7th October 1994.
    The prescribed area referred to is so much of the catchment area of the Rivers Tweed and Eye as lies within Scotland. The area is illustrated on a map attached to the 1980 Order and is defined by reference to a detailed large scale map which may be inspected at the principal office of the Scottish Office Agriculture and Fisheries Department, Edinburgh, on any working day between 10.00 am and 4.00 pm.
    The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
