The Blue Eared Pig Disease (Amendment) Order 1991

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 8(1), 15(4), 17(1), 23, 25 and 83(2) of the Animal Health Act 1981[1], and of all other powers enabling them in that behalf, hereby make the following Order:
Title and commencement 1. This Order may be cited as the Blue Eared Pig Disease (Amendment) Order 1991 and shall come into force on 18th September 1991.
Amendment 2. The Blue Eared Pig Disease Order 1991[2] shall be amended as follows
(a) in article 2(1) for the definition of "disinfectant" there shall be substituted the following definition
""disinfectant" means a disinfectant listed in Schedule 1 or Schedule 2 to the Diseases of Animals (Approved Disinfectants) Order 1978[3] as approved for use in respect of Fowl Pest;"
(b) in article 2(1) in the definition of "infected area" for the words "article 12(1)" there shall be substituted the words "article 11(1)";
(c) in article 5(3)(b) for the words "in the notice" there shall be substituted the words "in a notice";
(d) in article 10(2) the words "as a civil debt" shall be deleted;
(e) in article 11(2) for the words "by the Minister" there shall be substituted the words "in the declaratory order";
(f) n article 12(1)(b) for paragraph (ii) there shall be substituted the following
"(ii) by such road as may be specified in the declaratory order, provided the vehicle in which it is carried does not park on or leave the road; or"
;
(g) after article 12(2) there shall be added the following paragraph
" (3) No person shall hold a sale of pigs on market premises in the infected area except
(a) in any slaughtermarket, or
(b) under the authority of a licence granted by a veterinary inspector."
;
(h) in article 15(a) after the reference to "12(2)" there shall be inserted the reference "12(3)";
(i) n article 15(b) the reference to "5(3)" shall be deleted;
(j) n article 15(c) for the words "8 or 12(c)" there shall be substituted the words "8, 12(1)(c) or 12(3)";
(k) in Schedule 2 in form A for the words "a notice in form B served by a veterinary inspector" there shall be substituted the words "a notice in form B served by an inspector".

This Order amends the Blue Eared Pig Disease Order 1991 so as to reduce restrictions on the movement of pigs (article 2(f)), to provide for controls on the marketing of pigs (article 2(g)), to make consequential amendments and correct some minor errors.
