EDUCATION, ENGLAND AND WALES

The Education (School Curriculum and Related Information) (Wales) (Amendment) Regulations 1991

Laid before Parliament 6th August 1991
Coming into force 28th August 1991

    In exercise of the powers conferred on the Secretary of State by section 8(5) and (7) of the Education Act 1980[1] and sections 22, 103 and 232(5) of the Education Reform Act 1988[2], and after consulting with such persons with whom consultation appeared to him to be desirable, the Secretary of State for Wales hereby makes the following Regulations:-
    Citation, commencement and application
        1.    -

        (1)  These Regulations may be cited as the Education (School Curriculum and Related Information) (Wales) (Amendment) Regulations 1991 and shall come into force on 28th August 1991.

        (2)  These Regulations apply to schools in Wales only.
    Interpretation
        2.    In these Regulations "the principal Regulations" means the Education (School Curriculum and Related Information) (Wales) Regulations 1991[3].
    Amendment of the Principal Regulations
        3.    The principal Regulations are hereby amended as follows:-
       (a) for the reference in paragraph (4)(a) of regulation 2 to "subsection (1)(c)" there shall be substituted "subsection (1)(a)";
       (b) for paragraph (5) of regulation 2 there shall be substituted:-
        "  (5)  For the purposes of any such reference the information specified in paragraph 1 of Schedule 2, so far as it relates to the chairman of the governors and is correct at the date specified for the purposes of regulation 12(2), shall be deemed to relate to the school year to which the rest of the information specified in the said paragraph relates." ;
       (c) for the reference in paragraph (1) of regulation 3 to "section 8(5) of the Act of 1980" there shall be substituted "section 8(5)(a) of the Act of 1980";
       (d) for the reference in paragraph (3) of regulation 4 to "regulation 17 of Schedule 2" there shall be substituted "paragraph 15 of Schedule 2";
       (e) for the reference in paragraph (2) of regulation 5 to "subsection (9) of section 8 of the Act of 1980" there shall be substituted "subsection (1) of section 8 of the Act of 1980"; and
       (f) for the reference in paragraph (2) of regulation 9 to "paragraph 17 of Schedule 2" there shall be substituted "paragraph 15 of Schedule 2".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    The Education (School Curriculum and Related Information) (Wales) Regulations 1991 (S.I. 1991/1658) ("the principal Regulations") contain errors which it is necessary to correct by means of Amendment Regulations.
    Regulation 2(5)(b) of the principal Regulations is superfluous and consequently regulation 3(b) of the Amendment Regulations provides that regulation 2(5)(a) of the principal Regulations becomes regulation 2(5).
    The remainder of the provisions of regulation 3 of the Amendment Regulations correct errors of reference in the principal Regulations.
