AGRICULTURE

The Feeding Stuffs (Amendment) Regulations 1991

Coming into force 30th July 1991

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 66(1), 68(1), (1A) and (3), 69(1), (3), (6) and (7), 70(1), 73(3), 74(1), 74A and 84 of the Agriculture Act 1970[1] and now vested in them[2] and of all other powers enabling them in that behalf, after consultation in accordance with section 84(1) of the said Act with such persons or organisations as appear to them to represent the interests concerned, and the Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[3] for the purposes of section 2(2) of the European Communities Act 1972[4] in relation to the common agricultural policy of the European Economic Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2), and of all other powers enabling them in that behalf, hereby make the following Regulations:—
    Title and commencement
        1.    These Regulations may be cited as the Feeding Stuffs (Amendment) Regulations 1991, and shall come into force on 30th July 1991.
    Further amendment of the Feeding Stuffs Regulations 1988
        2.    The Feeding Stuffs Regulations 1988[5] are hereby further amended in accordance with regulation 3.
        3.—(1)  In Schedule 4, for paragraph 8 there shall be substituted the following paragraph:
            "8.    No material shall contain any added aromatic or appetising substance other than one named or described in column 2 of Part VII, or any such substance specified which, taking account of any such substance which is naturally present, exceeds the maximum content (if any) specified in relation thereto in column 5 of that Part. No material shall contain any substance specified in column 2 of Part VII unless the material is for an animal listed opposite the substance in question in column 4 of that Part."


        (2)  In Part II of the table in Schedule 4 ("PERMITTED COLOURANTS"), in the provision relating to astaxanthin for trout and salmon in column 1 ("EEC No") there shall be inserted "E161j".

        (3)  In Part IV of the table in Schedule 4 ("PERMITTED BINDERS, ANTI-CAKING AGENTS AND COAGULANTS"), in CHAPTER B before the provisions relating to bentonite and montmorillonite there shall be inserted the following provisions:
      E553

        "Sepiolite
        Hydrated magnesium silicate of sedimentary origin, containing at least 60% sepiolite and maximum 30% montmorillonite.


        Asbestos free
      All species of animals 20,000 All feeding stuffs


        (4)  In Schedule 4 ("AROMATIC AND APPETISING SUBSTANCES"), for Part VII of the table there shall be substituted the contents of Part I of the Schedule to these Regulations.

        (5)  In Schedule 7—
       (a) after item 1.4 ("Lower fungi") there shall be inserted the contents of Part II of the Schedule to these Regulations;
       (b) after the provisions relating to the product itemised at 3.1.3 in column 2 there shall be inserted the following provisions:
        3.1.4 Concentrated liquid sodium DL-methionine technically pure (CH3S(CH2)2—CH(NH2)—COO)Na DL-methionine minimum 40.0% Sodium: minimum 6.2% All animal species Declarations to be made on the label or packaging of the product:—the name "concentrated liquid sodium DL-methionine"——methionine content —moisture content.
       (c) after the provisions relating to the product itemised at 3.2.5 in column 2 there shall be inserted the following provisions:
        3.2.6 L-lysine phospate and its by-products produced by fermentation with Brevibacterium lactofermentum [NH2—(CH2)4—CH(NH2)—COOH]H3PO4 Sucrose ammonia and fish solubles L-lysine minimum 35% Phosphorus: minimum 4.3% Poultry, pigs Declaration to be made on the label or packaging of the product:— the name "L-lysine phosphate and its by products from fermentation"—L-lysine and moisture content
       (d) for the provisions relating to item 4 ("Hydroxy-analogues of amino acids") there shall be substituted the contents of Part III of the Schedule to these Regulations.
