The Education Reform Act 1988 (Application of Section 122 to Institutions in Wales) Order 1991

Made 7th June 1991
Coming into force in accordance with article 1

    In exercise of the powers conferred on the Secretary of State by section 227(4) of the Education Reform Act 1988[1], the Secretary of State for Wales hereby makes the following Order, a draft of which has been laid before Parliament and has been approved by Resolution of each House of Parliament pursuant to section 232(3) of that Act:—
        1.    This Order may be cited as the Education Reform Act 1988 (Application of Section 122 to Institutions in Wales) Order 1991 and shall come into force on the day after the day it is made.
        2.    Section 122 of the Education Reform Act 1988 is hereby applied in relation to institutions in Wales.

EXPLANATORY NOTE

(This note is not part of the Order)
    Section 122 of the Education Reform Act 1988 enables the Secretary of State, by order, to provide for the establishment of bodies corporate for the purpose of conducting certain institutions providing higher education as described in that section. Section 227 provides that section 122 shall not apply in relation to institutions in Wales but enables the Secretary of State, by order, to apply the section in relation to such institution with or without modifications. This Order applies section 122 in relation to institutions in Wales.
