ENVIRONMENTAL PROTECTION

The Environmental Protection Act 1990 (Commencement No. 8) Order 1991

Made 28th May 1991

    The Secretary of State, in exercise of his powers under section 164(3) of the Environmental Protection Act 1990[1], hereby makes the following Order:
    Citation
        1.    This Order may be cited as the Environmental Protection Act 1990 (Commencement No. 8) Order 1991.
    Provisions coming into force on 31st May 1991
        2.    The following provisions of the Environmental Protection Act 1990 shall come into force on 31st May 1991—
      sections 29 to 32;
      section 50;
      section 51;
      section 60 in so far as it relates to anything deposited at a place for the deposit of waste, or in a receptacle for waste, provided by a waste disposal contractor under arrangements made with a waste disposal authority;
      section 68;
      section 71;
      section 72;
      section 75;
      section 77;
      section 147;
      section 162(1) in so far as it relates to paragraph 31(1) to (3), (4)(a) and (c) and (5)(b) and (c) of Schedule 15;
      section 162(2) in so far as it relates to the repeal in Part II of Schedule 16 of section 2 of the Control of Pollution Act 1974[2] and the repeals made in that Part in relation to sections 7(2) and 9(1) of the Control of Pollution (Amendment) Act 1989[3].

EXPLANATORY NOTE

(This note is not part of the Order)
    Article 2 of this Order brings into force on 31st May 1991 provisions of the Environmental Protection Act 1990 relating to—
      (a) the separation of waste regulation from waste disposal functions where the same authority has both functions;
      (b) waste disposal plans of waste regulation authorities;
      (c) functions of waste disposal authorities, including transitional arrangements;
      (d) supervision and enforcement;
      (e) registers relating to deposits in the sea etc;
      (f) certain amendments of the Control of Pollution (Amendment) Act 1989 and related repeals.
