The Movement of Animals (Restrictions) (Amendment) Order 1991

Coming into force 24th May 1991

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 8(1), 17(1), 23, 72, 83(2), 87(2) and 88(2) of the Animal Health Act 1981[1] , and of all other powers enabling them in that behalf, hereby make the following Order:
    Title
        1.    This Order may be cited as the Movement of Animals (Restrictions) (Amendment) Order 1991.
    Amendment
        2.    The Movement of Animals (Restrictions) Order 1990[2] shall be amended as follows:—
       (a) in article 3(1) (interpretation and application)—
         (i) after the definition of"carcase" there shall be inserted the following definition:—
            ""infected area" means an area declared to be an infected area under article 4A(1);" and
         (ii) after the definition of"the Minister" and"the Ministry" there shall be inserted the following definition:—
            ""slaughterhouse" means—
            (a) in relation to England and Wales, a slaughterhouse or knacker's yard as defined in section 34 of the Slaughterhouses Act 1974[3] , and
            (b) in relation to Scotland, a slaughterhouse as defined in section 22 of the Slaughter of Animals (Scotland) Act 1980[4] ;" ; and
       (b) after article 4 there shall be inserted the following articles:—

          "Declaration of infected area
              4A—(1)  If the Minister knows or suspects that disease exists in any area he may, by special order, declare the area to be an infected area.

              (2)  An area shall remain an infected area until such date as may be specified in the special order or, if none, until the special order is withdrawn.

              (3)  The provisions of article 4B shall apply in an infected area.

              (4)  Any premises which are partly inside and partly outside an infected shall be deemed to be wholly inside that area.


          Restrictions on movement of animals within and out of an infected area
              4B—(1)  No person shall move an animal out of an infected area—
            (a) except under the authority of a licence granted by a veterinary inspector; or
            (b) unless the animal is moved through the area from a place outside of the area direct to another place outside the area with all practicable speed and by the most direct route without being unloaded in the area.

              (2)  A licence mentioned in paragraph (1)(a) above shall permit the movement of the animal to which it relates to either of the following destinations—
            (a) a slaughterhouse; or
            (b) premises for examination.

              (3)  No person shall move an animal from any farm, holding or agricultural premises in an infected area to any other farm, holding or agricultural premises in that area except under the authority of a licence granted by a veterinary inspector." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Movement of Animals (Restrictions) Order 1990 so as to enable the Minister to declare any area in which he knows or suspects disease to exist to be an infected area (article 2(b)).
    The Order further prohibits the movement of animals within or out of an infected area except under licence to certain specified destinations (article 2(b)).
