VETERINARY SURGEONS

The Veterinary Surgeons Qualifications (EEC Recognition) (German Democratic Republic Qualifications) Order 1991

    Whereas Her Majesty in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 3rd day of May 1991 to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty's absence from the United Kingdom to summon and hold on Her Majesty's behalf Her Privy Council and to signify thereat Her Majesty's approval for anything for which Her Majesty's approval in Council is required:
    And whereas a draft of this Order has been laid before Parliament and has been approved by a resolution of each House of Parliament:
    Now, therefore, His Royal Highness The Prince Andrew, Duke of York, and His Royal Highness The Prince Edward, being authorised thereto by the said Letters Patent, and in pursuance of the powers conferred on Her Majesty by section 2(2) of the European Communities Act 1972[1] , are pleased, by and with the advice of Her Majesty's Privy Council, on Her Majesty's behalf to order, and it is hereby ordered, as follows:—
    Citation and commencement
        1.    This Order may be cited as the Veterinary Surgeons Qualifications (EEC Recognition) (German Democratic Republic Qualifications) Order 1991 and shall come into force on 1st July 1991.
    Amendment to provision for recognition of qualifications in veterinary medicine
        2.—(1)  In section 5A of the Veterinary Surgeons Act 1966[2] (right of holders of recognised European qualifications to be registered) after subsection (3) there shall be inserted the following subsection—
      "  (3A)  A person holding a qualification as to training received in the territory of the former German Democratic Republic but which does not satisfy the requirements laid down by the Training Directive shall not be entitled to be registered by virtue of that qualification unless—
        (a) that qualification indicates that such training commenced before German unification,
        (b) that qualification indicates that the holder is entitled to practise as a veterinary surgeon throughout the territory of Germany to the same extent as the holder of the German State examination certificate in veterinary medicine, and
        (c) he produces to the registrar a certificate of the competent German authority that he has lawfully practised veterinary surgery in Germany for at least three consecutive years during the five years preceding the date of issue of the certificate." .


        (2)  In Schedule 1A to the Veterinary Surgeons Act 1966 (recognised European qualifications in veterinary surgery) under the sub-heading"Germany" , paragraph 2 (relating to diplomas issued by the competent authorities in the German Democratic Republic) shall be deleted and the figure"1" shall be omitted from the beginning of the remaining paragraph.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order, which is made under the European Communities Act 1972, amends the Veterinary Surgeons Act 1966 for the purpose of implementing Council Directive 90/658/EEC[3] which amends Council Directive 78/1026/EEC[4] relating to the right of establishment of veterinary surgeons and their freedom to provide veterinary services.
    Following German unification, holders of German Democratic Republic veterinary qualifications will be able to practise in the United Kingdom provided they can meet specified conditions.
