The Control of Pollution Act 1974 (Commencement No. 20) (Scotland) Order 1991

Made 3rd May 1991

    The Secretary of State, in exercise of the powers conferred on him by section 109(2) of the Control of Pollution Act 1974[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation
        1.    This Order may be cited as the Control of Pollution Act 1974 (Commencement No. 20) (Scotland) Order 1991.
    Commencement of provisions on 31st May 1991
        2.    The following provisions of the Control of Pollution Act 1974 shall come into force in Scotland on 31st May 1991:-
      Schedule 4 so far as it concerns the repeal of sections 25(1)(c) and (4) and 26(2), (4), (7), (8) and (9) of the Rivers (Prevention of Pollution) (Scotland) Act 1951[2] and section 108(2) so far as it gives effect to those repeals in that Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 31st May 1991 the repeal of certain provisions in the Rivers (Prevention of Pollution) (Scotland) Act 1951 made by Schedule 4 to the Control of Pollution Act 1974. The provisions repealed are section 25(1)(c) and (4) which give power to make byelaws for the control of sanitary appliances on vessels and section 26(2), (4) and (7) to (9) which contain supplementary provisions.
