The Montrose (Pilotage) Harbour Revision Order 1990

The Secretary of State for Transport in exercise of the powers
conferred on him by section 14 of the Harbours Act 1964[1]
, and now vested in him[2]
and of all powers enabling him in that behalf and on the
application of the Trustees of the harbour of Montrose in accordance
with section 7(5) of the Pilotage Act 1987[3]
, hereby makes the following Order:
Citation and commencement
1. This Order may be cited as the Montrose (Pilotage) Harbour Revision
Order 1990 and shall come into force on the date fixed in accordance
with the provisions of the Statutory Orders (Special Procedure) Acts
1945 and 1965[4]
.
Interpretation
2. In this Order
"harbour" means the harbour of Montrose as described in Article 19 of the
Montrose Harbour Revision Order 1974[5]
;
"level of high water" means the level of mean high water springs;
"signed plan" means the plan signed in triplicate by an Under Secretary in the
Department of Transport copies of which have been deposited as follows,
that is to say, one copy at the Department of Transport, one copy with
the Sheriff Clerk of the Sheriff Court district of Arbroath and one copy
at the principal office of the Trustees at South Quay, Ferryden,
Montrose DD10 9SL;
"Trustees" means the Trustees of the harbour incorporated by the Montrose
Harbour Act 1837[6]
.
Extension of limits of jurisdiction for purposes of pilotage
3. The limits within which the Trustees shall have jurisdiction for the
purposes of pilotage under Part 1 of the Pilotage Act 1987 shall include
(in addition to the harbour) the area to the east of the existing
harbour, shaded pink on the signed plan, and bounded by a straight line
from the eastern extremity of the level of high water from Scurdie Ness
Lighthouse for a distance of 1450 metres or thereabouts to a point
latitude 56°42"09'N longitude 02°24"58'W
intersecting an arc of 1210 metres radius from Scurdie Ness Lighthouse
and then in an arc of 1210 metres radius from Scurdie Ness Lighthouse to
a point latitude 56°42"28'N longitude 02°25"12'W
then in a straight line in a west-south-westerly direction for a
distance of 1230 metres or thereabouts to a position latitude
56°42"19.2'N longitude 02°26"20.9'W.

By virtue of section 7(5) of the Pilotage Act 1987 a direction
given by a harbour authority for the purpose of making pilotage
compulsory for ships navigating in a specified area shall not apply to
any area which is outside the authority's harbour unless the limits of
jurisdiction of the authority for pilotage purposes have been extended
to cover that area.
This Order accordingly extends the limits of jurisdiction of the
Trustees of the harbour of Montrose for pilotage purposes under Part I
of the Pilotage Act 1987 so as to include an area outside their harbour
in respect of which the Trustees consider that pilotage should be
compulsory.
The applicants for this Order are the Trustees of the harbour of
Montrose.
