TERMS AND CONDITIONS OF EMPLOYMENT

The Employment Code of Practice (Trade Union Ballots on Industrial Action) Order 1991

Made 12th April 1991

    Whereas—
        (1)  in pursuance of section 3 of the Employment Act 1980[1] the Secretary of State in 1990 issued a Code of Practice on trade union ballots on industrial action;

        (2)  in pursuance of section 12(1), (2)(a) and (3) of the Employment Act 1990[2] (hereinafter referred to as"the 1990 Act" ) the Secretary of State proposed to revise that Code of Practice for the purpose of bringing it into conformity with subsequent statutory provisions, and accordingly laid the draft of the revised Code of Practice before each House of Parliament;

        (3)  in pursuance of section 12(5) and (6) of the 1990 Act, neither House of Parliament having resolved within the period of 40 days beginning with the day on which the draft revised Code of Practice was so laid that no further proceedings should be taken on it, the Secretary of State is issuing the revised Code of Practice in the form of the draft;
    Now, therefore, the Secretary of State, in exercise of the power conferred on him by section 12(6) of the 1990 Act, hereby makes the following Order:—
    Citation
        1.    This Order may be cited as the Employment Code of Practice (Trade Union Ballots on Industrial Action) Order 1991.
    Appointed day for revised Code of Practice
        2.    The said revised Code of Practice on trade union ballots on industrial action shall come into effect on 20th May 1991.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order appoints 20th May 1991 as the day upon which the revised Code of Practice on trade union ballots on industrial action which is being issued by the Secretary of State under section 12 of the Employment Act 1990 comes into effect. The Code was originally issued in April 1990, and has been revised in order to bring it into conformity with changes made by the Employment Act 1990 to the law relating to trade union ballots on industrial action.

[1] 1980 c. 42; section 3(1) was amended by section 18(1) of the Employment Act 1988 (c. 19) to enable the Secretary of State to issue Codes of Practice containing such practical guidance as he thinks fit for the purpose of promoting what appear to him to be desirable practices in relation to the conduct by trade unions of ballotsand elections. back
