The Housing Act 1988 (Commencement No. 5 and Transitional Provisions) Order 1991

Made 26th March 1991

    The Secretary of State for the Environment, in exercise of the powers conferred on him by section 141(2) and (4) of the Housing Act 1988[1] , and of all other powers enabling him in that behalf, hereby makes the following Order:
        1.—(1)  This Order may be cited as the Housing Act 1988 (Commencement No. 5 and Transitional Provisions) Order 1991.

        (2)  In this Order"the 1985 Act" means the Housing Associations Act 1985[2] .
        2.    Subject to the saving in article 3, section 140(2) of the Housing Act 1988 shall come into force on 1st April 1991 insofar as it relates to the repeal of the following provisions of the 1985 Act—
      section 55 (hostel deficit grant), and
      sections 56 and 57 in their application to hostel deficit grant.

        3.    The repeal of sections 55 to 57 of the 1985 Act shall not apply in relation to hostel deficit grant payable to an association for a period which expires before 1st April 1991.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 1st April 1991 the provisions of section 140(2) of the Housing Act 1988, insofar as not already in force, in relation to certain aspects of Schedule 18 of that Act relating to hostel deficit grant (subject to certain transitional provisions).
