LOCAL GOVERNMENT, ENGLAND AND WALES

The District of South Herefordshire (Electoral Arrangements) Order 1991

Made 22nd March 1991
Coming into force in accordance with article 2

    Whereas in pursuance of section 51(1) of the Local Government Act 1972[1] , the Local Government Boundary Commission for England on 14th May 1990 submitted proposals for the future electoral arrangements for the District of South Herefordshire;
    Now, therefore, in exercise of the power conferred upon me by sections 51(2) and 67 of that Act, I hereby make the following Order:
        1.    This Order may be cited as the District of South Herefordshire (Electoral Arrangements) Order 1991.
        2.    This Order shall come into force on 2nd May 1991 except that for the purpose of all proceedings preliminary or relating to an election to be held on or after that day, it shall come into force forthwith.
        3.—(1)  The existing wards of the District of South Herefordshire shall be abolished and that district shall be divided into thirty-three wards which shall bear the names set out in column 1 of Schedule 1 to this Order, and each such ward shall comprise the existing areas specified opposite thereto in column 2 of that Schedule.

        (2)  The number of councillors to be elected for each ward constituted by paragraph (1) above shall be the number specified in column 3 of the Schedule 1 to this Order opposite to the name of the ward as given in column 1 of that Schedule.
        4.—(1)  Subject to the provisions of article 5 below, the elections of councillors shall be by thirds.

        (2)  Subject to the provisions of article 5 below, the order of retirement of councillors shall be as set out in Schedule 2 to this Order.
        5.—(1)  The councillors who immediately before the coming into force of this Order represent the existing Broad Oak, Burghill, Burmarsh, Dinedor Hill, Dinmore Hill, Golden Valley, Kingsthorne, Merbach, Munstone, Olchon, Pontrilas, Ross-on-Wye East,Ross-on-Wye West, Thinghill, Tram Inn and Whitfield wards of the District shall represent the ward of the same name as constituted by this Order.

        (2)  Any casual vacancy existing immediately before the coming into force of this Order in the representation of one of those existing wards shall be deemed to exist in the representation of the ward of the same name as constituted by this Order.

        (3)  The councillors for the Backbury, Clehonger East, Clehonger West, Credenhill, Doward, Fownhope, Garron, Gorsley, Hagley, Harewood End, Hollington, Old Gore, Penyard, Stoney Street, Swainshill, Walford and Wilton wards of the District as constituted by this Order shall be elected at the ordinary elections of councillors in 1991.

        (4)  Two councillors for each of the Ross-on-Wye East and Ross-on-Wye West wards of the District as constituted by this Order shall be elected at the ordinary elections of councillors in 1991.

        (5)  The councillors elected in 1991 for the Backbury, Clehonger West, Credenhill, Hagley, Hollington and Swainshill wards of the District shall retire in 1994.

        (6)  The councillor elected in 1991 for the Stoney Street ward of the District shall retire in 1992.

        (7)  Of the councillors elected in 1991 for the Clehonger East and Ross-on-Wye West wards of the District, other than on an election to fill a casual vacancy—
       (a) one shall retire in 1992 being, subject to paragraphs (10) and (11) below, the councillor elected by the smaller number of votes;
       (b) the remaining councillor shall retire in 1995.

        (8)  Both the councillors elected in 1991 for the Ross-on-Wye East ward of the District, other than on an election to fill a casual vacancy, shall retire in 1995.

        (9)  In the case of an equality of votes between any persons elected which makes it uncertain which of them is to retire in any such year, the person to retire in that year shall be determined by lot.

        (10)  If an election of councillors for the Clehonger East ward or the Ross-on-Wye West ward of the District is not contested, the person to retire in each such year shall be determined by lot.

        (11)  Where under this article any question is to be determined by lot, the lot shall be drawn at the next practicable meeting of the council after the question has arisen, and the drawing shall be conducted under the direction of the person presiding at the meeting.

        (12)  Except as otherwise provided in the foregoing paragraphs of this article, the term of office of councillors shall be four years, and all councillors shall retire on the fourth day after the ordinary day of election of councillors of the district in the year of retirement and the newly elected councillors shall come into office on the day on which their predecessors retire.

        (13)  In this article"the District" means the District of South Herefordshire.
        6.—(1)  The ordinary elections of parish councillors elected in 1991 for any parish or ward of a parish situated in the Hollington ward of the District of South Herefordshire shall take place in 1994 and thereafter ordinary elections shall take place every fourth year.

        (2)  The ordinary elections of parish councillors for any parish or ward of a parish situated in the Backbury, Broad Oak, Burghill, Burmarsh, Credenhill, Dinedor Hill, Dinmore Hill, Golden Valley, Hagley, Kingsthorne, Merbach, Munstone, Olchon, Pontrilas, Stoney Street, Swainshill, Thinghill, Tram Inn and Whitfield wards of the District of South Herefordshire shall take place in the ordinary year of election of the councillor for the district ward in which the parish or ward of the parish is situated.

        (3)  The ordinary elections of parish councillors for the parish of Clehonger shall take place in 1992 and every fourth year thereafter.

        (4)  The parish councillors to whom the foregoing paragraphs of this article apply shall retire on the fourth day after the ordinary day of election of parish councillors in the year of retirement and the newly elected councillors shall come into office on the day on which their predecessors retire.
        7.    The registration officer shall make such re-arrangement or alteration of the register of local government electors as may be necessary on account of the coming into force of this Order.
