COUNTRYSIDE

The Environmental Protection Act 1990 (Commencement No. 6 and Appointed Day) Order 1991

Made 4th March 1991

    The Secretary of State, in exercise of the powers conferred upon him by sections 130(4), 131(3) and 164(3) of the Environmental Protection Act 1990[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
        1.    This Order may be cited as the Environmental Protection Act 1990 (Commencement No. 6 and Appointed Day) Order 1991.
        2.    In this Order "the Act" means the Environmental Protection Act 1990.
        3.    The amendments made by sections 128, 130 and 132 of the Act, and section 162(2) of the Act in so far as it relates to the repeals to the Countryside Act 1968[2] and the Wildlife and Countryside Act 1981[3] in Part VI of Schedule 16 to the Act, shall come into force on 1st April 1991.
        4.—(1)  The day appointed under section 130(4) for the discharge of the respective functions of the Countryside Council for Wales and the Countryside Commission is 1st April 1991.

        (2)  The day appointed under section 131(3) for the discharge of the nature conservation functions of the Nature Conservancy Council for England, the Nature Conservancy Council for Scotland and the Countryside Council for Wales is 1st April 1991.

EXPLANATORY NOTE

(This note is not part of the Order)
    S.I. 1990/2226 brought into force on 5th November 1990, sections 128 to 139 (save for the amendments made by sections 128, 130 and 132) of the Environmental Protection Act 1990 ("the Act") which relate to the creation of new Councils for nature conservation in Great Britain and countryside matters in Wales (the Nature Conservancy Council for England, the Nature Conservancy Council for Scotland and the Countryside Council for Wales).
    This Order brings into force on 1st April 1991 the amendments made by sections 128, 130 and 132 of the Act and the consequential repeals in Part VI of Schedule 16 to the Act in so far as they relate to the Countryside Act 1968 and the Wildlife and Countryside Act 1981.
    This Order appoints (under section 130(4) of the Act) 1st April 1991 as the day on and after which the Countryside Council for Wales and the Countryside Commission shall discharge their respective countryside functions.
    This Order also appoints (under section 131(3) of the Act) 1st April 1991 as the day on and after which the new Councils shall discharge their respective nature conservation functions in place of the Nature Conservancy Council established under the Nature Conservancy Council Act 1973 (c. 54).
