The Isles of Scilly (Community Care) Order 1991

Made 8th March 1991
Coming into force 1st April 1991

    The Secretary of State for Health, in exercise of the powers conferred by section 67(6) of the National Health Service and Community Care Act 1990[1], and of all other powers enabling him in that behalf hereby makes the following Order:-
    Citation and commencement
        1.    This Order may be cited as the Isles of Scilly (Community Care) Order 1991 and shall come into force on 1st April 1991.
    Application of Part III of the 1990 Act to Isles of Scilly
        2.    Sections 42 to 44 and 46 to 50 of the National Health Service and Community Care Act 1990 shall apply to the Isles of Scilly with the modification that, in their application to those Isles, for each reference to a local authority there shall be substituted a reference to the Council of the Isles of Scilly constituted under the Isles of Scilly Order 1978[2].

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order extends, with modification of references to a local authority, section 42 to 44 and 46 to 50 of the National Health Service and Community Care Act 1990 to the Isles of Scilly. Those sections amend certain sections of the National Assistance Act 1948 (c. 29) relating to accommodation provided by local authorities; make provision for local authority plans and assessment of needs of community care services, the inspection of premises used for the provision of such services and the transfer of staff from health service to local authorities; and amend section 7 of the Local Authority Social Services Act 1970 (c. 42) (Secretary of State's powers as respects social services functions of local authorities).
