ROAD TRAFFIC

The Passenger and Goods Vehicles (Recording Equipment) Regulations 1991

Coming into force 1st April 1991

    The Secretary of State for Transport, being a Minister designated[1] for the pupose of section 2(2) of the European Communities Act 1972[2]in relation to the regulation of the type, description, construction or equipment of vehicles, in exercise of the powers conferred by that section, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Passenger and Goods Vehicles (Recording Equipment) Regulations 1991 and shall come into force on the 1st April 1991.
        2.    In section 97(7) of the Transport Act 1968[3] in the definition of "the Community Recording Equipment Regulation" after the words "on recording equipment in road transport" there shall be inserted the words "as amended by article 1 as read with article 3 of Commision Regulation (EEC) No. 3314/90 of 16th November 1990[4] and".
        3.    In regulation 1(3) of the Passenger and Goods Vehicles (Recording Equipment) Regulations 1979[5] in the definition of the "Community Recording Equipment Regulation" after the words "on recording equipment in road transport" there shall be inserted the words "as amended by article 1 as read with article 3 of Commission Regulation (EEC) No. 3314/90 of 16th November 1990 and".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the definition of "the Community Recording Equipment Regulation" in section 97(7) of the Transport Act 1968 and regulation 1(3) of the Passenger and Goods Vehicles (Recording Equipment) Regulations 1979 to take account of the amendments to Council Regulation (EEC) No. 3821/85 (O.J. No. L370. 31.12.1985, p. 8) made by Commission Regulation (EEC) No. 3314/90 (O.J. No. L318, 17.11.1990, p. 20). The amendments to the Council Regulation have been made to take account of technical changes equipment in road transport.
    By virtue of article 3 of the Commision Regulation the amendments take effect in respect of recording equipment (tachographs) in new vehicles brought into service for the first time as from 1st January 1996.
