NATIONAL HEALTH SERVICE, ENGLAND AND WALES

The National Health Service Training Authority (Abolition) Order 1991

Made 25th February 1991
Laid before Parliament 4th March 1991
Coming into force 1st April 1991

    The Secretary of State for Health, in exercise of powers conferred by sections 11 and 126(3) and (4) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, hereby makes the following Order:—
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the National Health Service Training Authority (Abolition) Order 1991 and shall come into force on 1st April 1991.

        (2)  In this Order "the Authority" means the National Health Service Training Authority.
    Revocation of Orders and abolition of the Authority
        2.    The National Health Service Training Authority (Establishment and Constitution) Order 1983[2] and the National Health Service Training Authority (Establishment and Constitution) Amendment Order 1986[3] are hereby revoked and the Authority is hereby abolished.
    Enforceability of rights
        3.    Any right which was enforceable by or against the Authority shall be enforceable—
       (a) by or against South Western Regional Health Authority[4] if it is in respect of a claim made by a former officer of the Authority arising out of his employment.
       (b) in any other case, by or against the Secretary of State.
    Transfer of property
        4.    All property of the Authority is hereby transferred to the Secretary of State.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order revokes the Orders under which the National Health Service Training Authority was established as a special health authority under the National Health Service Act 1977 (article 2). The Order abolishes the Authority and provides for the transfer of the Authority's rights and liablilites (article 3) and the Authority's property (article 4).
