The Community Health Councils (Amendment) Regulations 1991

Made 12th February 1991
Laid before Parliament 27th February 1991
Coming into force 1st April 1991

    The Secretary of State for Wales, in exercise of the powers conferred on him by sections 13(1), 18(1), 20(3), 126(3), (4) and (5) and 128(1) of and paragraphs 2(a) and (c) and 6 of Schedule 7 to the National Health Service Act 1977[1]and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
    Citation, commencement and application
        1.—(1)  These Regulations may be cited as the Community Health Councils (Amendment) Regulations 1991 and shall come into force on 1st April 1991.

        (2)  These Regulations apply only to Community Health Councils in Wales.
    Amendment of the Community Health Councils Regulations
        2.—(1)  The Community Health Councils Regulations 1985[2]shall be amended as follows.

        (2)  In regulation 2(5) (exercise of functions relating to Councils) for the words "A District Authority in Wales" there shall be substituted the words "In Wales, the Welsh Health Common Services Authority[3]".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Regulation 2(5) of the Community Health Councils Regulations 1985 requires a District Health Authority in Wales, in accordance with any directions which may be given by the Secretary of State, to assist the Secretary of State in—
      (a) inviting applications for membership of Community Health Councils in Wales from voluntary organisations;
      (b) appointing officers of such Councils;
      (c) administering arrangements for the provision of accommodation, services and other facilities for such Councils;
      (d) paying such expenses of such Councils as are approved by the Secretary of State.

    Regulation 2(5) also requires a District Health Authority in Wales, in accordance with any such directions, to exercise the functions of the Secretary of State with respect to the payment of travelling and other allowances to members of such Councils.
    These Regulations amend the said regulation 2(5) by substituting a reference to the Welsh Health Common Services Authority for the reference in regulation 2(5) to a District Health Authority.
