SOCIAL SECURITY

The Community Charges (Information Concerning Social Security) Amendment Regulations 1991

Laid before Parliament 15th February 1991
Coming into force 1st April 1991

    The Secretary of State for Social Security, in exercise of the powerss conferred by section 143(1) and (2) and 146(6) of, and paragraph 14(1) and (2)(c) of Schedule 2 to, the Local Government Finance Act 1988[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Community Charges (Information Concerning Social Security) Amendment Regulations 1991 and shall come into force on 1st April 1991.

        (2)  In these Regulations "the principal Regulations" means the Community Charges (Information Concerning Social Security) Regulations 1989[2].
    Amendment of regulation 3 of the principal Regulations
        2.    In regulation 3 of the principal Regulations (supply of relevant information to registration officers)—
       (a) in paragraph (2) for the words "paragraphs (3) and (4)" there shall be substituted the words "paragraph (3)";
       (b) for paragraph (3) there shall be substituted the following paragraph—
        "  (3)  The information is information as to the name and address of any person aged 18 or over, and of any partner aged 18 or over of that person, where that person—
          (a) is awarded income support but has not, at the time of the award, made a claim for community charge benefit at the appropriate social security office; or
          (b) changes his address, while in receipt of income support." ;
       (c) paragraph (4) shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Community Charges (Information concerning Social Security) Regulations 1989 so as to permit the Secretary of State to provide relevant information to a community charges registration officer where either a person is awarded income support but does not at the time of the award claim community charge benefit, or a person changes his address while in receipt of income support.
