DEFENCE

The Royal Air Force Terms of Service (Amendment) Regulations 1990

Made 28th November 1990
Laid before Parliament 4th December 1990
Coming into force 1st January 1991

    The Defence Council, in exercise of the powers conferred upon them by section 2 of the Armed Forces Act 1966[1], hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Royal Air Force Terms of Service (Amendment) Regulations 1990 and shall come into force on 1st January 1991.
    Amendments to Regulations
        2.—(1)  Regulation 5 of the Royal Air Force Terms of Service Regulations 1985[2] (engagement with right to transfer to the reserve on notice) shall be amended in accordance with the following provisions of this regulation.

        (2)  In paragraph (1), for the words "17 years 6 months" there shall be substituted "16 years".

        (3)  In paragraph (2) —
       (a) for the words from "either (but not both)" to "to say: (a)" there shall be substituted "the right";
       (b) the words from "or (b)" to "the relevant date," shall be omitted; and
       (c) for the words "such rights" there shall be substituted "such right".

        (4)  For paragraph (3), there shall be substituted the following paragraph —
      "  (3)  A person enlisted pursuant to this Regulation shall retain the right conferred thereby to transfer to the reserve notwithstanding that his term is extended under Regulation 14(1)." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations further amend the Royal Air Force Terms of Service Regulations 1985 by (i) reducing the minimum age for men enlisted on a notice engagement from 17 years 6 months to 16 years; (ii) bringing the right to transfer to the reserve given to women into line with that given to men; and (iii) preserving that right notwithstanding the extension of terms of air force service under regulation 14(1).
