The New Towns (Transfer of Housing Stock) (Amendment) Regulations 1990

Made 28th November 1990
Laid before Parliament 6th December 1990
Coming into force 27th December 1990

    The Secretary of State for the Environment, in exercise of the powers conferred upon him by sections 172 and 190(1) of the Local Government and Housing Act 1989[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the New Towns (Transfer of Housing Stock) (Amendment) Regulations 1990 and shall come into force on 27th December 1990.
    Amendment of New Towns (Transfer of Housing Stock) Regulations 1990
        2.    The New Towns (Transfer of Housing Stock) Regulations 1990[2]shall be amended by the insertion of the following paragraph after regulation 2(3)—
      "  (4)  Nothing in these Regulations shall—
        (a) prevent a new town corporation making a disposal in exercise of their powers under section 17 or, as the case may be, section 36 of the New Towns Act 1981[3], or
        (b) affect a corporation's duty, in the period before a disposal of a dwelling in pursuance of these Regulations, to act in accordance with Part V (The Right to Buy) of the Housing Act 1985[4] with respect to that dwelling;
      and, where a corporation transfer an estate or interest in housing stock under any of those provisions, these Regulations shall cease to apply for the disposal of that estate or interest." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the New Towns (Transfer of Housing Stock) Regulations 1990 (which make provision requiring the transfer of new town housing stock) and provide that those Regulations shall not prevent a new town corporation from making a disposal under the New Towns Act 1981 or affect their duty, in the period before disposing of a dwelling under the Regulations, to act in accordance with Part V of the Housing Act 1985 with respect to the dwelling. Where a corporation transfer an estate or interest in housing stock under those Acts, the Regulations cease to apply for the disposal of that estate or interest.
