LOCAL GOVERNMENT, SCOTLAND

The Local Government Act 1988 (Defined Activities) (Competition) (Scotland) Amendment Regulations 1990

    The Secretary of State, in exercise of the powers conferred on him by sections 6(3) and 15(6) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement, extent and interpretation
        1.—(1)  These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (Scotland) Amendment Regulations 1990, shall come into force on 18th December 1990 and shall apply to Scotland only.

        (2)  In these Regulations "the principal Regulations" means the Local Government Act 1988 (Defined Activities) (Competition) (Scotland) Regulations 1988[2].
    Amendment of the principal Regulations
        2.    In column 4 (other cleaning) of Schedule 2 to the principal Regulations-
       (a) the words "Groups 6 & 12" opposite the reference to "1 January 1991" in column 1 (date) shall be deleted;
       (b) for the words "Groups 5 & 11" opposite the reference to "1 August 1991" in column 1 there shall be substituted the words "Groups 6 & 12";
       (c) for the words "Group 10" opposite the reference to "1 January 1992" in column 1 there shall be substituted the words "Groups 5, 10 & 11".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Regulation 5 of the Local Government Act 1988 (Defined Activities) (Competition) (Scotland) Regulations 1988 (S.I. 1988/1413) ("the principal Regulations") provides that section 6 of the Local Government Act 1988 ("the 1988 Act") (restrictions on carrying out functional work) applies where local authorities, placed in groups in Schedule 1 to the principal Regulations, propose to carry out functional work described in section 2(2) of the 1988 Act after the dates specified in Schedule 2 to the principal Regulations for the different groups.
    The effect of these Regulations is to postpone the application of section 6, in respect of functional work, being "other cleaning work", which is to be carried out by certain groups of local authority, from 1st January 1991 or 1st August 1991, to 1st August 1991 or 1st January 1992 respectively.
