AGRICULTURE

The Environmentally Sensitive Areas Designation (Wales) (Welsh Language Provisions) Order 1990

Coming into force 12th September 1990


    Whereas, pursuant to section 18(1) of the Agriculture Act 1986[1], the Secretary of State has by order designated certain areas in Wales as environmentally sensitive areas[2];
    And whereas, pursuant to section 18(4) of the said Act, the Secretary of State has specified in the orders designating the above-mentioned areas the requirements as to agricultural practices, methods and operations and the installation or use of equipment which must be included in agreements made under section 18(3) of the said Act as respects agricultural land in those areas;
    Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 18(1), (4) and (11) of the said Act, as extended by section 2(2) of the Welsh Language Act 1967[3], and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Order:—
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Environmentally Sensitive Areas Designation (Wales) (Welsh Language Provisions) Order 1990 and shall come into force on 12th September 1990.

        (2)  In this Order—
      "agreement" means an agreement under section 18(3) of the Agriculture Act 1986;
      "requirements" means requirements as to agricultural practices, methods and operations and the installation or use of equipment specified in an order made under section 18 of the Agriculture Act 1986 and which must be included in an agreement.


        (3)  Except where otherwise expressly provided, any reference in this Order to a numbered Schedule shall be construed as a reference to the Schedule bearing that number in this Order.
    Prescribed versions of definitions, requirements and additional provisions
        2.    The requirements and definitions specified in Schedule 1 are hereby prescribed as versions in Welsh which may be included in an agreement as respects land in the area designated by article 3 of the Environmentally Sensitive Areas (Cambrian Mountains) Designation Order 1986[4] or as respects land in the area designated by article 3 of the Environmentally Sensitive Areas (Cambrian Mountains — Extension) Designation Order 1987[5] in place of the definitions and requirements respectively specified in article 2(1) of and the Schedule to each of those Orders.
        3.    The requirements and definitions specified in Schedule 2 are hereby prescribed as versions in Welsh which may be included in an agreement as respects land in the area designated by article 3 of the Environmentally Sensitive Areas (Lleyn Peninsula) Designation Order 1987[6] in place of the definitions and requirements respectively specified in article 2(1) of and Schedule 1 to that Order.
        4.    The additional provisions and definitions specified in Schedule 3 are hereby prescribed as versions in Welsh which may be included in an agreement as respects land in the area designated by article 3 of the Environmentally Sensitive Areas (Lleyn Peninsula) Designation Order 1987 in place of the definitions and additional provisions as to agricultural practices, methods and operations and the installation and use of equipment respectively specified in article 2(1) of and Schedule 2 to that Order.
