COMMUNITY CHARGES, ENGLAND AND WALES

The Charge Limitation (England) (Maximum Amount) Order 1990

Made 12th July 1990
Coming into force in accordance with article 1

    Whereas the Secretary of State for the Environment, being of the opinion mentioned in subsection (1)(a) of section 100 of the Local Government Finance Act 1988[1] in respect of the Council of the London Borough of Hillingdon, has pursuant to that section designated that authority as regards the financial year beginning with 1st April 1990;
    And whereas the Secretary of State has notified that authority in writing pursuant to section 102(1) of that Act of his decision so to designate it, the principles determined under section 100(4) of that Act in relation to it, and the amount which he proposed should be the maximum for the amount calculated by it in relation to that year under section 95(4) of that Act;
    And whereas that authority has informed the Secretary of State by notice in writing under section 102(5)(a) of that Act that, for the reasons stated in the notice, it believes the maximum amount stated under section 102(1)(c) of that Act should be such as the authority has stated in its notice;
    And whereas a draft of this Order has been laid before and approved by resolution of the House of Commons;
    Now, therefore, the Secretary of State, after considering all such information he thinks is relevant, in exercise of the power conferred on him by section 104(2) of the Local Government Finance Act 1988 and of all other powers enabling him in that behalf, hereby makes the following Order:
    Title and commencement
        1.    This Order may be cited as the Charge Limitation (England) (Maximum Amount) Order 1990 and shall come into force on the day after the day on which it is made.
    Interpretation
        2.    In this Order "the Act" means the Local Government Finance Act 1988.
    Maximum amount
        3.    The amount which the amount calculated by the Council of the London Borough of Hillingdon in relation to the year beginning with 1st April 1990 under section 95(4) of the Act is not to exceed is £141,700,000, which amount does not exceed the amount already calculated by that authority in relation to that year under the said section 95(4).

    This Order states the amount which the amount calculated by the Council of the London Borough of Hillingdon in relation to the chargeable financial year beginning with 1st April 1990 under section 95 of the Local Government Finance Act 1988 is not to exceed.
