FOOD

The Food Safety Act 1990 (Commencement No. 1)Order 1990

Made 2nd July 1990

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health, and the Secretary of State for Wales, acting jointly, in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 4(1) and 60(3) of the Food Safety Act 1990[1], hereby make the following Order:—
        1.—(1)  This Order may be cited as the Food Safety Act 1990 (Commencement No. 1) Order 1990.

        (2)  In this Order, references to sections and Schedules are references to sections and Schedules of the Food Safety Act 1990.
        2.    The following provisions shall come into force on 3rd July 1990:
       (a) for the purposes of section 13 (emergency control orders) sections 1 to 3, 4(2), 5, 6, 7(3), 20, 21(1), (5) and (6), 22, 29, 32 to 36, 41, 42, 44, 46, 48(1) to (3), 49(1) and (3) to (5), 50, 53(1) to (4), 57 and 58(1); and
       (b) for the purposes of section 51 (amendment to the Food and Environment Protection Act 1985[2] ) sections 1(1) and (2) and 53(1), paragraphs 29 and 30 of Schedule 3 and, so far as relating to those paragraphs, section 59(1).

EXPLANATORY NOTE

(This note is not part of the Order)
    Upon the passing of the Food Safety Act 1990 sections 13 and 51, and paragraphs 12 to 15 of Schedule 2 (and , so far as relating to those paragraphs, section 52) of that Act came into force.
    This Order, for the purposes of section 13 (emergency control orders), brings into force, on 3rd July 1990, sections 1 to 3, 4(2), 5, 6, 7(3), 20, 21(1), (5) and (6), 22, 29, 32 to 36, 41, 42, 44, 46, 48(1) to (3), 49(1) and (3) to (5), 50, 53(1) to (4), 57 and 58(1) of that Act.
    It also brings into force on that date, for the purposes of section 51 (amendment to the Food and Environment Protection Act 1985), sections 1(1) and (2) and 53(1), paragraphs 29 and 30 of Schedule 3 and, so far as relating to those paragraphs, section 59(1) of that Act.
