PUBLIC PASSENGER TRANSPORT

The Public Service Vehicles (Drivers' Licences) (Amendment) Regulations 1990

Coming into force 18th June 1990

    The Secretary of State for Transport, in exercise of the powers conferred by sections 22(3), 52(1)(b)(ii) and 60(1) and (2) of the Public Passenger Vehicles Act 1981[1], and of all other enabling powers, and after consultation with representative organisations in accordance with section 61(2) of that Act[2], hereby makes the following Regulations:
        1.    These Regulations may be cited as the Public Service Vehicles (Drivers' Licences) (Amendment) Regulations1990 and shall come into force on 18th June 1990.
        2.    The Public Service Vehicles (Drivers' Licences) Regulations 1985[3] shall be amended in accordance with the following provisions of these Regulations.
        3.    In regulation 9(1) (Persons who may conduct tests) there shall be inserted the following sub-paragraphs -
        ", or
        (c) he is authorised to do so by the Secretary of State for Defence, and the test is of a person in the service of the Crown under his department, or
        (d) he is authorised to do so, in England and Wales, by the chief officer of any fire brigade maintained in pursuance of the Fire Services Act 1947[4] or, in Scotland, by the firemaster of such a brigade, and the test is of a member of any such brigade or of a person employed in the driving of motor vehicles for the purposes of any such brigade, or
        (e) he is authorised to do so by any chief officer of police and the test is —
          (i) of a member of a police force, or
          (ii) of a person employed in the driving of motor vehicles for police purposes by a police authority or by the Receiver for the Metropolitan Police District." .
        4.    For paragraph (2) of regulation 10 (Fees for tests and the provision of facilities) there shall be substituted the following paragraph—
      "  (2)  The fee hereby prescribed as the fee for the provision by commissioners of facilities for an applicant for a licenceto undergo a test shall be
        (a) £42 if the application for the licence, with which the fee is required to be paid by paragraph (3) below, is made before 18th June 1990; and
        (b) £45 if that application is made on or after that date."

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend regulation 9of the Public Service Vehicles (Drivers' Licences) Regulations 1985 so as to permit the Armed Forces, the Fire Brigadeand the Police to authorise persons to conduct driving tests for public service vehicle driver's licences.These Regulations further amend regulation 10(2) of those Regulations by increasing from £42 to £45 the fee payable by an applicant for a public service vehicle driver's licence for the provision by a Traffic Commissioner of facilities to undergo a driving test.
