LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Authorities (Goods and Services) (Public Bodies) Order 1990

Made 5th March 1990
Laid before Parliament 9th March 1990
Coming into force 1st April 1990

    The Secretary of State for the Environment in exercise of the powers conferred by section 1(5) and (6) of the Local Authorities (Goods and Services) Act 1970[1] and now vested in him[2] and of all other powers enabling him in that behalf and the Secretary of State for Wales in exercise of the powers conferred on him by those provisions and of all other powers enabling him in that behalf, hereby make the following Order:
    Citation and commencement
        1.    This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) Order 1990 and shall come into force on 1st April 1990.
    Designation of public bodies
        2.    Each of the following bodies which is a person appearing to the Secretaries of State to be exercising functions of a public nature shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to England and Wales:

    The City Literary Institute;

    Medway Housing Society Limited.
    Restriction on agreements which may be entered into
        3.—(1)  Agreements which may be entered into by the Society by virtue of this Order shall only be for the provision by a local authority to the Society of administrative, professional or technical services in connection with the management or maintenance by the Society of houses situated on land transferred to the Society by a local authority under section 32 of the Housing Act 1985[3].

        (2)  In paragraph (1)—
      "houses" has the same meaning as in section 56 of the Housing Act 1985; and
      "the Society" means Medway Housing Society Limited.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order designates the City Literary Institute and the Medway Housing Society Limited as public bodies under the Local Authorities (Goods and Services) Act 1970. The effect of the designation is to allow a local authority to provide goods and services to these bodies. In the case of Medway Housing Society Limited this is limited to the provision of administrative, professional or technical services in connection with certain housing.
