COMPANIES

The Companies Act 1989 (Commencement No. 1) Order 1990

Made 24th January 1990

    The Secretary of State, in exercise of his powers under section 215(2) of the Companies Act 1989[1], hereby makes the following Order:—
        1.    This Order may be cited as the Companies Act 1989 (Commencement No. 1) Order 1990.
        2.    The following provisions in Part III of the Companies Act 1989 shall come into force on 25th January 1990 —
       (a) section 75(2);
       (b) section 75(3), in so far as it provides for the insertion in subsection (1) of section 180 of the Financial Services Act 1986[2] of a new paragraph (oo) after paragraph (o) of that subsection, and section 75(4) in so far as it provides a definition of "public servant" for the purposes of that new paragraph; and
       (c) section 75(7).
        3.    In Part X of the Companies Act 1989, section 216 will come into force on 25th January 1990.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 25th January 1990 provisions of the Companies Act 1989 which amend section 180 of the Financial Services Act 1986. The amendments permit the disclosure of information which has been obtained under the Financial Services Act and which would otherwise be restricted, for the purpose of any disciplinary proceedings relating to the discharge by a public servant of his duties.
    The Order also brings into force on 25th January 1990 the provision giving the short title of the 1989 Act.
