EDUCATION, ENGLAND AND WALES

The Education (Higher Education Corporations) (No. 7) Order 1989

Coming into force 15th January 1990

    In exercise of the powers conferred by sections 122(1) and (6) and 126(2) of, and paragraphs 1(2) and 4 of Schedule 7 to, the Education Reform Act 1988 [1]the Secretary of State for Education and Science, having consulted in accordance with the said paragraph 4 such associations of local authorities as appeared to him to be concerned, hereby makes the following Order:
        1.    This Order may be cited as the Education (Higher Education Corporations) (No. 7) Order 1989 and shall come into force on 15th January 1990.
        2.    There shall be established, as from 15th January 1990, a body corporate by the name of Gloucestershire College of Arts and Technology (Higher Education) to conduct, as from 1st April 1990, the institution known by that name being an institution which appears to the Secretary of State to satisfy the criteria set out in section 122(1) of the Education Reform Act 1988 and whose full-time equivalent enrolment number for courses of higher education appears to him to exceed 350.
        3.    1st April 1990 is hereby appointed as the transfer date for the said corporation for the purposes of section 126 of that Act.
        4.    Gloucestershire County Coup is hereby specified as the local authority entitled to nominate one local authority nominee as an initial nominee member of the said corporation.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order makes provision for the establishment of a body corporate to conduct Gloucestershire College of Arts and Technology (Higher Education). That body which, by virtue of paragraph 1(2) of Schedule 7 to the Education Reform Act 1988 will have the name of Gloucestershire College of Arts and Technology (Higher Education), is established on 15th January 1990 to prepare itself for the conduct of that institution from 1st April 1990 which is appointed as the transfer date for the purposes of section 126 of that Act. The order also specifies Gloucestershire County Council as the local authority able to nominate one local authority nominee to become a member of that body corporate.
