EDUCATION, ENGLAND AND WALES

The Education (Publication of Schemes for Financing Schools) Regulations 1989

Made 11th December 1989
Laid before Parliament 20th December 1989
Coming into force 15th January 1990

    In exercise of the powers conferred by sections 42(1) and 232(5) of the Education Reform Act 1988[1] the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:
        1.—(1)  These Regulations may be cited as the Education (Publication of Schemes for Financing Schools) Regulations 1989 and shall come into force on 15th January 1990.

        (2)  In these Regulations a "scheme" means a scheme (including a scheme replacing or varying a previous scheme) made by a local education authority under section 33 of the Education Reform Act 1988 (schemes for financing county and voluntary schools).
        2.    For the purposes of section 42(1) of the Education Reform Act 1988 (prescribed manner of publication of schemes) a scheme shall be published by-
       (a) furnishing a copy to the governing body and a copy to the head teacher of each school to which the scheme relates, and
       (b) making a copy available for reference by parents and other persons at all reasonable times and without charge at-
         (i) each school to which the scheme relates;
         (ii) each education office of the relevant local education authority, and
         (iii) each public library in the area of the relevant local education authority.
        3.    For the purposes of section 42(1)(b) of the Education Reform Act 1988 (prescribed occasions on which publication of schemes is required) a scheme shall be published on the entry into force of a variation of the scheme by a direction of the Secretary of State under section 35(9) of the Education Reform Act 1988.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Sections 33 and 34 of the Education Reform Act 1988 require local education authorities to prepare and submit to the Secretary of State for his approval schemes for financing county and voluntary schools maintained by them. Section 42(1) of that Act requires such schemes, on their entry into force and on such subsequent occasions as may be prescribed by regulations, to be published in the manner prescribed by regulations.
    These Regulations prescribe the manner in which such schemes are to be published for the purposes of section 42(1) (regulation 2 ).
    The Regulations also prescribe a subsequent occasion on which such schemes are to be published in the prescribed manner (regulation 3 ).
