The Motor Vehicles (Type Approval) (Amendment) (No.2) Regulations 1989

    The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other enabling powers, hereby makes the following Regulations:-
        1.    These Regulations may be cited as the Motor Vehicles (Type Approval) (Amendment) (No.2) Regulations 1989 and shall come into force on 31st December 1989.
        2.—(1)  Part I of Schedule 2 to the Motor Vehicles (Type Approval) Regulations 1980[3] is hereby amended as follows.

        (2)  In column 2-

EXPLANATORY NOTE

(This note is not part of the Regulations)
    1.
    These Regulations further amend the Motor Vehicles (Type Approval) Regulations 1980 as follows:
      (a) Type approval requirements involving the use of unleaded petrol are amended to take account of Commission Directive 89/491/EEC which adapts to technical progress Council Directives 70/157/EEC, 70/220/EEC, 72/245/EEC, 72/306/EEC, 80/1268/EEC and 80/1259/EEC.
      (b) The type approval requirements relating to European emission standards for cars below 1.4 litres are, as an alternative to the existing requirements, the requirements of Council Directive 70/220/EEC as amended by Council Directive 74/290/EEC, Commission Directives 77/102/EEC and 78/665/EEC and Council Directives 83/351/EEC, 88/436/EEC and 89/458/EEC.
      (c) The type approval requirements relating to end-outline marker lamps, front position (side) lamps, rear position (side) lamps and stop lamps for motor vehicles and their trailers are, as an alternative to the existing requirements, the requirements of Council Directive 76/758/EEC as amended by Commission Directive 89/516/EEC.
      (d) The type approval requirements relating to motor vehicle headlamps which function as main-beam and/or dipped-beam headlamps and to incandescent electric filament lamps for such headlamps are, as an alternative to the existing requirements, the requirements of Council Directive 76/761/EEC as amended by Commission Directive 89/517/EEC.
      (e) The type approval requirements relating to rear fog lamps for motor vehicles and their trailers are, as an alternative to the existing requirements, the requirements of Council Directive 77/538/EEC as amended by Council Directive 89/518/EEC.
