NORTHERN IRELAND

The Fair Employment (Northern Ireland) Act 1989 (Commencement) Order 1989

Made 19th October 1989

    In exercise of the powers conferred upon me by section 60(2) of the Fair Employment (Northern Ireland) Act 1989[1], I hereby make the following Order:
        1.    This Order may be cited as the Fair Employment (Northern Ireland) Act 1989 (Commencement) Order 1989.
        2.—(1)  Subject to the following paragraphs of this article, the Fair Employment (Northern Ireland) Act 1989 shall come into force on 1st January 1990.

        (2)  Sections 1(3), 29, 47 and 57 of that Act shall come into force on 1st November 1989.

        (3)  The commencement of section 49 of that Act shall not apply for the purposes of acts done before 1st January 1990.

        (4)  The commencement of the amendments made by—
       (a) paragraph 15 of Schedule 2 to that Act, (b) paragraph 16(3)(b) of that Schedule, (c) paragraph 17 of that Schedule, (d) paragraph 21(c) of that Schedule, and (e) paragraphs 24, 25, 26, 32 and 33 of that Schedule and the commencement of the repeals made by Schedule 3 of that Act of the whole or part of the following provisions of the Fair Employment (Northern Ireland) Act 1976[2], which provisions are—
         (i) sections 44 to 48,
         (ii) section 51,
         (iii) section 53(4),
         (iv) the definitions of "complainant", "the county court", "finding" and "the injured person",
         (v) section 59(2), and
         (vi) paragraph 11 of Schedule 1, shall not apply for the purposes of any complaint or act to which section 50(2) of the Fair Employment (Northern Ireland) Act 1989 applies.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force on 1st January 1990 all of the provisions of the Fair Employment (Northern Ireland) Act 1989 except those provisions specified in article 2(2) which are brought into force on 1st November 1989. The commencement does not apply for the purposes set out in article 2(3) and (4).
