WATER, ENGLAND AND WALES

The Water Reorganisation (Pensions etc.) (Designated Persons) Order 1989

Coming into force 1st September 1989

    The Secretary of State for the Environment and the Secretary of State for Wales, acting jointly in exercise of the powers conferred on them by section 173 of the Water Act 1989[1] , hereby make the following Order:-
    Citation and commencement
        1.    This Order may be cited as the Water Reorganisation (Pensions etc.) (Designated Persons) Order 1989 and shall come into force on 1st September 1989.
    Persons designated for the purposes of section 173(1)(b) of the Water Act 1989
        2.—(1)  The persons referred to in paragraph (2), who appear to the Secretaries of State to be persons whose activities at a time before the transfer date consisted in, or were connected with, the carrying out of functions which are transferred by the Water Act 1989 or which correspond to such functions or to other functions under that Act, are designated for the purposes of section 173(1)(b) of that Act (payments to pension funds in respect of former officers and employees of designated persons).

        (2)  The persons mentioned in paragraph (1) are-
       (a) British Water International Limited;
       (b) Foundation for Water Research;
       (c) International Association on Water Pollution Research and Control;
       (d) International Water Supply Association;
       (e) The Water Authorities Association;
       (f) Water Research Centre (1989) plc; and
       (g) Water Training.

EXPLANATORY NOTE

(This note is not part of the Order)
    Section 173 of the Water Act 1989 enables the Secretary of State, with the consent of the Treasury, to make payments into funds maintained for the purposes of regulations made under section 7 of the Superannuation Act 1972 in respect of certain liabilities falling from time to time to be met out of those funds. Those payments may relate to liabilities to or in respect of former officers or employees of persons designated by the Secretary of State whose activities before 1st September 1989 consisted in, or were connected with, the carrying out of functions which were transferred by the Water Act 1989 or functions similar to those functions or to other functions under that Act.
    This Order designates, for the purpose of making those payments, the following bodies-
      (a) British Water International Limited;
      (b) Foundation for Water Research;
      (c) International Association on Water Pollution Research and Control;
      (d) International Water Supply Association;
      (e) The Water Authorities Association;
      (f) Water Research Centre (1989) plc; and
      (g) Water Training.
