COMMUNITY CHARGES, ENGLAND AND WALES

The Community Charges (Miscellaneous Provisions) Regulations 1989

Made 26th June 1989
Laid before Parliament 30th June 1989
Coming into force 21st July 1989

    The Secretary of State for the Environment as respects England, and the Secretary of State for Wales as respects Wales, in exercise of the powers conferred on them by sections 19(1) and (5), 143(2) and 146(6) of, and paragraphs 1 and 3(3) of Schedule 4 to, the Local Government Finance Act 1988[1] , and of all other powers enabling them in that behalf, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Community Charges (Miscellaneous Provisions) Regulations 1989 and shall come into force on 21st July 1989.
    Service of summonses
        2.    In regulation 30(2) of the Community Charges (Administration and Enforcement) Regulations 1989[2] , after sub-paragraph (c) there is inserted-
      ", or (d) by leaving it at, or by sending it by post to him at, an address given by the person as an address at which service of the summons will be accepted." .
    Co-owners
        3.—(1)  The Local Government Finance Act 1988[3] is amended in accordance with this regulation.

        (2)  The following paragraph is inserted after paragraph 3 of Schedule 3-
            "3A.    References in paragraphs 1 and 2 above-
          (a) to any provision included in regulations under paragraph 2, 3 or 4(2)(e) of Schedule 2 above include references to any equivalent provision included in regulations under paragraph 21(a) of that Schedule,
          (b) to any provision included in regulations under any other paragraph of Schedule 2 above include references to any such provision as modified in its application by regulations under paragraph 21(b) of that Schedule." .



        (3)  In paragraph 27(5) of Schedule 4, after the words"paragraph 15, 19" there are inserted the words", 21B" .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Regulation 30(2) of the Community Charges (Administration and Enforcement) Regulations 1989 provides for the manner in which a summons issued in proceedings for a liability order may be served. Regulation 2 of these Regulations amends regulation 30(2) so as to provide expressly that the summons may be served at an address given by the person concerned as one where service will be accepted.
    Regulation 3 makes amendments to Schedules 3 and 4 to the Local Government Finance Act 1988 which are consequential on certain other amendments made by regulation 60 of the Community Charges (Administration and Enforcement) Regulations 1989 in relation to co-owners.
