The Transfer of Functions (Rag Flock and Other Filling Materials) Order 1989

The Queen's Most Excellent Majesty in Council

    Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 1975[1] , is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-
    Citation, interpretation and commencement
        1.—(1)  This Order may be cited as the Transfer of Functions (Rag Flock and Other Filling Materials) Order 1989.

        (2)  In this Order"the 1951 Act" means the Rag Flock and Other Filling Materials Act 1951[2] .

        (3)  This Order shall come into force on 13th July 1989.
    Transfer of functions
        2.—(1)  There are hereby transferred to the Secretary of State those functions which by virtue of the 1970 provisions are exercisable by the Secretary of State for the Environment and the Secretary of State for Scotland acting jointly under-
       (a) section 8(1) of the 1951 Act (extension to other filling materials of provisions relating to rag flock); and
       (b) section 30 of that Act (regulations).

        (2)  In paragraph (1) above,"the 1970 provisions" means articles 2(1) and 5(1) of, and paragraph 17 of Schedule 3 to, the Secretary of State for the Environment Order 1970[3] .
    Supplemental
        3.—(1)  The 1951 Act shall be amended as follows-
       (a) in sections 8(1) and 30, for the words from the beginning to"jointly" there shall be substituted in each case the words"The Secretary of State" ; and
       (b) in section 15(4), for the words"the Ministers" there shall be substituted the words"the Secretary of State when" .

        (2)  In regulation 5(2) of the Rag Flock and Other Filling Materials Regulations 1981[4] (analysts) for the words"the Secretary of State for the Environment and the Secretary of State for Scotland" there shall be substituted the words"the Secretary of State" .

        (3)  This Order shall not affect the validity of anything done, or having effect as if done, by or in relation to the Secretary of State for the Environment or the Secretary of State for Scotland before the coming into force of this Order.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order transfers to the Secretary of State the functions under sections 8(1) (power to extend provisions as to rag flock to other filling materials) and 30 (power to make regulations) of the Rag Flock and Other Filling Materials Act 1951, which are currently exercisable by the Secretary of State for the Environment and the Secretary of State for Scotland acting jointly.
    The Order will permit the powers to be exercised by the Secretary of State for Trade and Industry.
