CLEAN AIR

The Smoke Control Areas (Exempted Fireplaces) (Scotland) Order 1989

Made 17th May 1989
Laid before Parliament 5th June 1989
Coming into force 26th June 1989

    The Secretary of State, in exercise of the powers conferred on him by sections 11(4) and 34(1) of the Clean Air Act 1956[1], and of all other powers enabling him in that behalf, and being satisfied that fireplaces of the classes described can be used for burning fuel other than authorised fuel without producing a substantial quantity of smoke, hereby makes the following Order:
    Citation, commencement and extent
        1.—(1)  This Order may be cited as the Smoke Control Areas (Exempted Fireplaces) (Scotland) Order 1989, and shall come into force on 26th June 1989.

        (2)  This Order shall extend to Scotland only.
    Classes of fireplace exempted from section 11 of the Clean Air Act 1956
        2.    The classes of fireplace described in column (1) of the Schedule to this Order shall, subject to the conditions specified in column (2) against that class, be exempted from the provisions of section 11 of the Clean Air Act 1956 (which enables local authorities to establish smoke control areas in which emission of smoke is an offence, but provides for the exemption of certain fireplaces or classes of fireplace).
