ROAD TRAFFIC

The Motor Vehicles (Driving Licences) (Amendment) (No. 2) Regulations 1989

    The Secretary of State for Transport, in exercise of the powers conferred by sections 85(2) and 107 of the Road Traffic Act 1972[1] , and now vested in him[2] , and all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of that Act, and with the approval of the Treasury, hereby makes the following Regulations:
        1.    These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 2) Regulations 1989 and shall come into force on 5th June 1989.
        2.    The Motor Vehicles (Driving Licences) Regulations 1987[3] shall be further amended in accordance with the provisions of these Regulations.
        3.    In regulation 19 (Fees in respect of tests) -
       (a) for paragraph (3)(b) there shall be substituted the following sub-paragraphs -
          "(b) in the case of Part II of the test for a motor bicycle and the test for motor vehicles of group E, £16.50; and
          (c) in the case of any other test, £18.00, save that no fee is payable in respect of a test to be taken in an invalid carriage." ; and
       (b) in paragraph (5) for "£16.50" there shall be substituted "£18.00" .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Motor Vehicles (Driving Licences) Regulations 1987 as previously amended by the Motor Vehicles (Driving Licences) (Amendment) Regulations 1988.
    Regulation 19(3)(b) of the 1987 Regulations is amended so as to create an additional fee category comprising both Part II of the test for motor bicycles and the test for motor vehicles of group E (Mopeds). The fee payable in respect of these tests remains at £16.50. The fee payable in respect of any other test (other than Part I of the test for motor bicycles which is not affected by these Regulations and remains at £15.60) is increased from £16.50 to £18.00. There continues to be no fee payable in respect of a test to be taken in an invalid carriage.
    Regulation 19(5) of the 1987 Regulations is amended so as to increase the fee payable to the Commissioner of Police of the Metropolis, in respect of a test of a person who is the holder of or is an applicant for a licence to drive a motor cab by virtue of the Metropolitan Public Carriage Act 1869 (c. 115), from £16.50 to £18.00.
