The Local Authority Social Services (Designation of Functions) Order 1989

Made 20th February 1989
Coming into force 21st February 1989

    Whereas a draft of this instrument was laid before Parliament in accordance with section 13(3) of the Local Authority Social Services Act 1970[1] and approved by resolution of each House of Parliament:
    Now, therefore, the Secretary of State for Health, in exercise of powers conferred by section 2(2) of the Local Authority Social Services Act 1970 hereby makes the following order:-
    Citation and commencement
        1.    This Order may be cited as the Local Authority Social Services (Designation of Functions) Order 1989 and shall come into force on the day after the day on which it is made.
    Functions to be discharged through a local authority's social services committee
        2.    The functions of local authorities under the following enactments are designated as being appropriate for discharge through a local authority's social services committee:-
    Enactment Nature of functions
    Disabled Persons (Services, Consultation and Representation) Act 1986[2]
    Sections 1 to 5, 7 and 8 except insofar as they assign functions to a local authority in their capacity of a local education authority. Representation and assessment of disabled persons.
    Access to Personal Files Act 1987[3]
    Section 1 insofar as it applies to personal information held for any purpose of the local authority's social services functions. Obligation to give access etc.

EXPLANATORY NOTE

(This note is not part of the Order)
    The councils of non-metropolitan counties, metropolitan districts and London boroughs and the Common Council of the City of London are each required by the Local Authority Social Services Act 1970 to establish a social services committee. This Order places within the responsibility of that committee certain functions of those authorities under the Disabled Persons (Services, Consultation and Representation) Act 1986 and under the Access to Personal Files Act 1987.
