The Hong Kong (Legislative Powers) Order 1989

Coming into force 27th March 1989

At the Court at Buckingham Palace, the 7th day of February 1989

Present,

The Queen's Most Excellent Majesty in Council

    Her Majesty, in exercise of the powers conferred upon Her by paragraph 3 of the Schedule to the Hong Kong Act 1985[1] and all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
    Citation and commencement
        1.—(1)  This Order may be cited as the Hong Kong (Legislative Powers) Order 1989.

        (2)  This Order shall come into force on 27th March 1989.
    Additional powers of the legislature of Hong Kong
        2.    In addition to any other power conferred on the legislature of Hong Kong, the Governor of Hong Kong, by and with the advice and consent of the Legislative Council of Hong Kong, may, to the extent required in order to give effect to an international agreement which applies to Hong Kong, and for connected purposes-
       (a) repeal or amend any enactment so far as it is part of the law of Hong Kong; and
       (b) make laws having extra-territorial operation.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order confers on the legislature of Hong Kong the power to repeal or amend enactments insofar as they are part of the law of Hong Kong, and to make laws having extra-territorial operation, in order to enable legislation to be enacted to give effect to international agreements which apply to Hong Kong.
