The Bermuda Constitution (Amendment) Order 1989

Made 7th February 1989
Laid before Parliament 15th February 1989
Coming into force 9th March 1989

At the Court at Buckingham Palace, the 7th day of February 1989

Present,

The Queen's Most Excellent Majesty in Council

    Her Majesty, in exercise of the powers conferred upon Her by section 1 of the Bermuda Constitution Act 1967[1] and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
    Citation, con- struction and commence- ment.
        1.—(1)  This Order may be cited as the Bermuda Constitution (Amendment) Order 1989 and shall be construed as one with the Bermuda Constitution Order 1968[2] (hereinafter referred to as "the principal Order" ).

        (2)  The principal Order and this Order may be cited together as the Bermuda Constitution Orders 1968 to 1989.

        (3)  This Order shall come into force on 9th March 1989.
    Amendment of section 62 of Constitution.
        2.    Section 62 of the Constitution set out in Schedule 2 to the principal Order is amended by substituting for subsection (2) the following-
      "  (2)  The Governor, acting in his discretion, may by directions in writing delegate, with the prior approval of the Secretary of State, to the Premier or any other Minister designated by him after consultation with the Premier such responsibility for any of the matters specified in subsection (1) of this section as the Governor may think fit upon such conditions as he may impose." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Constitution of Bermuda to enable the Governor to delegate, under certain conditions, responsibility to Ministers for defence, including the armed forces, in addition to the matters responsibility for which he was previously empowered to delegate, that is to say external affairs, internal security and the police.
