The General Practice Finance Corporation (Transfer of Property etc. and Abolition) Order 1989

Made 26th January 1989
Laid before Parliament 6th February 1989
Coming into force 27th February 1989

    In exercise of powers conferred by section 1(1) and (9) of the Health and Medicines Act 1988[1] and of all other powers enabling me in that behalf, I hereby make the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the General Practice Finance Corporation (Transfer of Property etc. and Abolition) Order 1989 and shall come into force on 27th February 1989.

        (2)  In this Order -
      "the Act" means the Health and Medicines Act 1988;
      "the Corporation" means the General Practice Finance Corporation[2] .

    Transfer of property, rights and liabilities of the Corporation
        2.    On 27th February 1989 all the property, rights and liabilities to which the Corporation is entitled or subject immediately before that date shall become the property, rights and liabilities of the General Practice Finance Corporation Limited, a company which is incorporated under the Companies Act 1985[3] (registered number 2334210) and is the company nominated for the purposes of section 1 of the Act by the Secretary of State.
    Abolition of the Corporation
        3.    The day appointed for the purposes of section 1(9) of the Act (as the day on which the Corporation shall cease to exist) is 27th February 1989.

EXPLANATORY NOTE

(This note is not part of the Order)
    Article 2 of this Order transfers on 27th February 1989 all the property, rights and liabilities of the General Practice Finance Corporation (a statutory corporation established for purposes including the making of loans to those providing general medical services in the national health service) to the General Practice Finance Corporation Limited.>
    Article 3 of this Order appoints 27th February 1989 as the day on which the statutory corporation is abolished.
