The Welfare of Poultry (Transport) (Amendment) Order 1989

Made 13th January 1989
Coming into force 3rd February 1989

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 8(1), 37(1) and (2) and 86(1) of the Animal Health Act 1981[1] and of all other powers enabling them in that behalf, hereby make the following Order:
    Title, commencement and extent
        1.    This Order may be cited as the Welfare of Poultry (Transport) (Amendment) Order 1989, shall apply to Great Britain, and shall come into force on 3rd February 1989.
    Amendment
        2.    Article 6 of the Welfare of Poultry (Transport) Order 1988[2] (protection of poultry during loading, unloading and transport) shall be amended as follows-
       (a) at the beginning of paragraph (3)(g) there shall be inserted the words "subject to paragraph (3A) below," ; and
       (b) after paragraph (3) there shall be inserted the following paragraph-
        "  (3A)  The provisions of paragraph (3)(g) above shall not apply in the case of-
          (a) ducks which are lifted or carried by the neck; or
          (b) geese which are lifted or carried by the base of both wings." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Welfare of Poultry (Transport) Order 1988 by providing that the restriction contained in that Order on poultry being lifted or carried by the head, neck, wing or tail shall not apply in the case of ducks which are lifted or carried by the neck or geese which are lifted or carried by the base of both wings (article 2).
