EDUCATION, ENGLAND AND WALES

The Education Support Grants (Amendment) (No. 2) Regulations 1988

Made 17th November 1988
Coming into force 1st December 1988

    In exercise of the powers conferred on the Secretary of State by sections 1(2) to (4) and (7) and 3(4) of the Education (Grants and Awards) Act 1984[1] , and after consulting, in accordance with section 3(5) of that Act, such bodies representing local education authorities as appear to them to be appropriate, the Secretary of State for Education and Science as respects England, and the Secretary of State for Wales as respects Wales, hereby make the following Regulations, a draft of which has been laid before Parliament and has been approved by resolution of each House of Parliament pursuant to section 3(2) of that Act:—
        1.    These Regulations may be cited as the Education Support Grants (Amendment) (No. 2) Regulations 1988 and shall come into force on 1st December 1988.
        2.    For regulation 4 of the Education Support Grants Regulations 1984[2] ("the principal regulations" ) there shall be substituted the following regulation—
            "4.—(1)  Subject to paragraphs (2), (3) and (4), grants in respect of approved expenditure shall be payable at the rate of 70 per cent. of such expenditure.

            (2)  Grants in respect of approved expenditure incurred on or after 1st April 1988 in respect of item 4(a) of the Schedule hereto shall be payable at the rate of 50 per cent. of such expenditure.

            (3)  Grants in respect of approved expenditure incurred on or after 1st April 1989 in respect of items 2, 3 and (as respects England) 14 of the Schedule hereto shall be payable at the rate of 50 per cent. of such expenditure.

            (4)  Grants in respect of approved expenditure incurred on or after 1st April 1989 in respect of item 20 of the Schedule hereto on the provision of computer hardware or the provision of staff in posts created on or after that date shall be payable at the rate of 50 per cent. of that expenditure.

            (5)  In this regulation "approved expenditure" means any expenditure which is approved as provided in regulation 3." .

        3.    For the Schedule to the principal regulations there shall be substituted the following Schedule—
