RIVER, SCOTLAND
SALMON AND FRESHWATER FISHERIES

The River Lunan Catchment Area Protection (Renewal) Order 1988

The Secretary of State, having received no complaints concerning the implementation of proposals, in exercise of the powers conferred on him by section 1(7) of the Freshwater and Salmon Fisheries (Scotland) Act 1976(^[1]) and of all other powers enabling him in that behalf, hereby makes the following Order:

Title and commencement
    1.    This Order may be cited as the River Lunan Catchment Area Protection (Renewal) Order 1988 and shall come into force on 7th October 1988.

Interpretation
    2.    In this Order—
"the 1983 Order" means the River Lunan Catchment Area Protection Order 1983(^[2]);


"the 1986 Order" means the River Lunan Catchment Area Protection (Renewal) Order 1986(^[3]).

Renewal of Order
    3.    The 1986 Order is hereby renewed.

Prohibition
    4.    During the period from 7th October 1988 to 6th October 1991, both dates inclusive, fishing for or taking freshwater fish in the inland waters in the area prescribed in article 4 of the 1983 Order, without legal right or without written permission from a person having such a right, is hereby prohibited.

This Order renews for the second time the River Lunan Catchment Area Protection Order 1983 which prohibited fishing for or taking freshwater fish in inland waters in the area prescribed in that Order without legal right or without written permission from someone having such a right. The effect of the renewal is that the prohibition has effect from 7th October 1988 to 6th October 1991.

The prescribed area referred to is that part of the catchment area of the River Lunan lying within Tayside Region. The area is illustrated on a map attached to the 1983 Order and is defined by reference to a detailed large scale map which may be inspected at the principal office of the Department of Agriculture and Fisheries for Scotland in Edinburgh, on any working day between 8.30 am and 4.30 pm.

The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
