PILOTAGE

The Irvine (Pilotage Powers) Order 1988

Made 1st September 1988
Laid before Parliament 9th September 1988
Coming into force 1st October 1988

    Whereas the Irvine Harbour Company is a harbour authority within the meaning of the Pilotage Act 1987[1] , but is not a competent harbour authority within the meaning of that Act, and whereas it wishes to be treated for the purposes of the Act as such an authority, now therefore the Secretary of State for Transport, on the application of the Irvine Harbour Company, in exercise of the powers conferred on him by sections 1(4) and 32(1) of the Pilotage Act 1987, and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Irvine (Pilotage Powers) Order 1988 and shall come into force on 1st October 1988.
    Interpretation
        2.    In this Order "the Company" means the Irvine Harbour Company.
    Application of Pilotage Act 1987
        3.—(1)  The Company shall be a competent harbour authority for the purposes of the Pilotage Act 1987.

        (2)  References in the Pilotage Act 1987 to the harbour authority's harbour in their application to the Company's harbour shall be taken as references to the area within the harbour which comprises the waters of the sea bounded by —
       (a) an imaginary straight line extending from Stevenston Burn (latitude 55° 37'.6N longitude 4° 45'.2W) one mile in a south westerly direction to a point at latitude 55° 36'.7N, longitude 4° 46'.3W;
       (b) an imaginary straight line extending from North Gailes Burn (latitude 55° 35'.5N longitude 4° 40'.0W) one mile in a south westerly direction to a point at latitude 55° 33'.3N longitude 4° 41'.0W;
       (c) an imaginary straight line joining the seaward ends of the two aforementioned straight lines, together with all bays, rivers, creeks and channels within that area.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that the Irvine Harbour Company is to be a competent harbour authority for the purposes of the Pilotage Act 1987 and the Order defines the area of its harbour for these purposes.
    The applicant for the Order is the Irvine Harbour Company, Stevenston, Ayrshire, KA20 3LN.
