The Berry Head and Berry Head (Southern Redoubt) (Areas of Special Protection) (Amendment) Order 1988

Made 17th August 1988
Coming into force 26th August 1988

    The Secretary of State, in exercise of the powers conferred on him by section 3(1) of the Wildlife and Countryside Act 1981[1] ("the Act" ) and of all other powers enabling him in that behalf, having complied with the requirements of section 26(4)(a) and (b) of the Act, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Berry Head and Berry Head (Southern Redoubt) (Areas of Special Protection) (Amendment) Order 1988 and shall come into force on 26th August 1988.

        (2)  In this Order,"the 1984 Order" means the Berry Head and Berry Head (Southern Redoubt) (Areas of Special Protection) Order 1984[2] .
    Amendments to the 1984 Order
        2.    The following amendments shall be made to the 1984 Order—
       (a) in article 1(2), after the definition of"the Berry Head (Southern Redoubt) Area of Special Protection" there shall be inserted the following definition:
          ""the Berry Head (Coastal Waters) Area of Special Protection" means the area specified in paragraph 3 of the Schedule hereto;"
       (b) in article 1(2), after the definition of"the deposited map" there shall be inserted the following definition:
          ""the second deposited map" means the map marked"Map referred to in the Berry Head and Berry Head (Southern Redoubt) (Areas of Special Protection) (Amendment) Order 1988" and signed by an Under Secretary in the Department of the Environment, which has been prepared in duplicate and of which one duplicate has been deposited and is available for inspection at the offices of the Torbay Borough Council, and the other has been deposited and is available for inspection at the offices of the Secretary of State for the Environment."
       (c) in article 3, after the words"the Berry Head (Southern Redoubt) Area of Special Protection" there shall be inserted the words"or the Berry Head (Coastal Waters) Area of Special Protection" ;
       (d) in the Schedule, the following paragraph shall be added:
          "3. That part of the coastal waters lying off Berry Head and the Southern Redoubt shown coloured blue and edged blue on the second deposited map."

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Berry Head and Berry Head (Southern Redoubt) (Areas of Special Protection) Order 1984 by establishing a part of the coastal waters lying off Berry Head and the Southern Redoubt as an area of special protection for wild birds under section 3 of the Wildlife and Countryside Act 1981.
