LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Defined Activities) (Specified Periods) (Wales) Regulations 1988

Laid before Parliament 19th August 1988
Coming into force 9th September 1988

    The Secretary of State for Wales in exercise of the powers conferred by sections 8(1) and 15(6) of the Local Government Act 1988[1] and all other powers enabling him in that behalf hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Specified Periods) (Wales) Regulations 1988 and shall come into force on9th September.
    Application
        2.    These Regulations apply only to work to be carried out in Wales.Specified Periods
        3.—(1)  In the case of an authority without education functions mentioned or described in Part I of the Schedule hereto, the second condition, set out in section 7(3) of the Local Government Act 1988, shall not be treated as fulfilled as respects an activity mentioned in column 1 of Part II of that Schedule if the period stated in the detailed specification by virtue of section 7(3)(c) is less than the period mentioned in column 2 of that Part or exceeds the period mentioned in column 3.

        (2)  In the case of an authority with education functions mentioned or described inPart I of the Schedule hereto, the second condition, set out in section 7(3) of the Local Government Act 1988 shall not be treated as fulfilled as respects an activity mentioned in column 1 of Part III of that Schedule if the period so stated in the detailed specification by virtue of section 7(3)(c) is less than the period mentioned in column 2 of that Part or exceeds the period mentioned in column 3.
