HOUSING, ENGLAND AND WALES

The Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) Regulations 1988

Made 11th July 1988
Coming into force 1st September 1988

    The Secretary of State for Wales in exercise of the powers conferred on him by section 176(1) and (5) of the Housing Act 1985[1] as extended by subsections (2) and (3) of the section 2 of the Welsh Language Act 1967[2] and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
        1.—(1)  These Regulations may be cited as the Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) Regulations 1988 and shall come into force on 1st September 1988.

        (2)  In these Regulations "the principal Regulations" means the Housing (Right to Buy) (Prescribed Forms) Regulations 1986[3].
        2.    The forms set out in Schedules 1 and 2 to these Regulations are hereby prescribed as versions in Welsh which may be used instead of the forms in Schedules 1 and 2 to the principal Regulations for the purposes of sections 122(1) and 124(1) of the Housing Act 1985.
        3.    Forms substantially to the like effect to the forms set out in Schedules 1 and 2 to these Regulations may be used.
        4.    The particulars to be contained in any notice, the form of which is prescribed by regulations 2 and 3 above, shall be those required by that form.
        5.—(1)  The Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) (No. 3) Regulations 1985[4] are hereby revoked.

        (2)  Nothing in these Regulations shall affect the validity of any notice served by a secure tenant under section 122(1) of the Housing Act 1985[5] before 1st November 1988 1988 if the notice was in the form prescribed by the regulations mentioned in paragraph (1) above or in a form substantially to the like effect.

[5] By virtue of section 2(2) of the Housing (Consequential Provisions) Act 1985 (c. 71), a notice served under section 5(1) of the Housing Act 1980 (c. 51) has effect as if served under section 122(1) of the Housing Act 1985. back
